// BOOKING TERMS
Last updated: 21 August 2026. These terms apply to all sessions booked on or after this date.
These terms govern every photography and videography session booked with Arlberg Collective, whether booked through this website, by email, by telephone or by message.
In these terms, “we”, “us” and “our” mean Arlberg Collective. “You” means the person making the booking. Where you book for a group, you do so on behalf of every member of that group and you confirm you have authority to accept these terms for all of them.
We provide ski and snowboard photography and videography across the Ski Arlberg area — St. Anton, Rendl, Nasserein, St. Christoph, Stuben, Lech, Zürs and Warth-Schröcken.
Each session includes the elements listed for that package on our website at the time you book. At the date of these terms that is:

Video add-ons, drone aerials and custom feature productions are quoted separately.
Group size. Prices are per session, never per person. A session covers up to six people. If more than six people take part, we may decline to photograph the additional people or agree a revised fee before the session starts.
Image counts. The image counts above are minimums we expect to deliver in normal conditions. Where light, weather or the group’s skiing means fewer usable frames, we will deliver every usable image from the session and tell you why the count is lower. Image counts are not a guarantee of a specific number of frames of any particular person.
Creative control. Selection, editing and colour treatment of images are ours. We do not supply unedited or RAW files, and we do not deliver frames we consider technically unusable.
Working days are Monday to Friday excluding Austrian public holidays. Where a Multi Day session runs across consecutive days, the five working days run from the final shooting day.
Prices are those published on our website when you book. Founding season rates apply to sessions booked and taking place on or before 31 January 2027. As a Kleinunternehmer we charge no VAT, so the price you see is the price you pay.
Deposit. A deposit of 30% of the session price is payable at the time of booking. Your booking is not confirmed until the deposit is received.
Balance. The remaining 70% is due 15 days before the session date. If you book within 15 days of the session date, the full price is payable immediately at the time of booking.
Late payment. If the balance is not paid by the due date we may treat the booking as cancelled by you and apply the cancellation charges in clause 5. Statutory default interest may apply.
Payment methods. Card payments are processed by Stripe. We never see or store your full card details. Bank transfer is available on request.
Cancellations must be sent in writing to hello@arlbergcollective.com. The date we receive your written cancellation is the date used to calculate the refund.

Changing your date. We will always try to move a session rather than lose it. Where we can offer an alternative date in the same season and you accept it, we will transfer your payment to the new date at no charge. One free date change per booking; further changes are treated as a cancellation and rebooking.
Late arrival and no-shows. Session time runs from the agreed meeting time. If you arrive late, we will do our best to make the time up, but we cannot always extend the session beyond the agreed finish. If you do not appear within 60 minutes of the meeting time and we cannot reach you, the session is treated as a no-show and no refund is due.
Because you book at a distance, you would ordinarily have a 14-day right of withdrawal under the Fern- und Auswärtsgeschäfte-Gesetz (FAGG).
That right does not apply to our sessions. Under § 18 Abs 1 Z 10 FAGG (implementing Art 16(l) of Directive 2011/83/EU), there is no right of withdrawal for contracts for services connected with leisure activities where the contract provides for a specific date or period of performance. A ski photography session booked for a named date falls squarely within that exemption.
The cancellation terms in clause 5 therefore apply instead, and they are more generous than the law requires for bookings made more than 14 days ahead.
Auf Deutsch: Gemäß § 18 Abs 1 Z 10 FAGG besteht kein Rücktrittsrecht bei Verträgen über Dienstleistungen im Zusammenhang mit Freizeitbetätigungen, wenn ein bestimmter Termin oder Zeitraum vorgesehen ist. Es gelten die Stornobedingungen in Punkt 5.
We never retain fees for anything outside anyone’s control. If the session cannot go ahead because lifts are closed, avalanche risk or weather make shooting unsafe, or visibility makes photography pointless, you may choose either:
The same applies if we cannot attend through illness, injury or equipment failure and cannot provide a suitable replacement photographer.
The decision to call off a session on safety grounds is ours, taken in good faith on the day. Poor light, flat light or cold alone are not automatically grounds for cancellation — we will discuss it with you and agree the sensible course.
We are not liable for your travel, accommodation, lift pass, guiding or other costs arising from a cancelled or rescheduled session. Please make sure your travel insurance covers these.
This clause is important. Please read it.
In Austria, guiding people off-piste is a regulated activity. We are photographers, not mountain guides. Where any part of your session takes place off-piste:
We are happy to recommend guides we trust, but any contract you make with a guide is between you and them. We are not their agent and take no commission or responsibility for their services.
You confirm on behalf of yourself and everyone in your group that:
Children and minors. Anyone under 18 must be accompanied by a parent or guardian, who must consent to their being photographed and to any use of those images.
Skiing and snowboarding are inherently risky. Participation in a session is at your own risk. We are not responsible for injury, loss or damage arising from the ordinary risks of skiing, from your own skiing, from the conduct of third parties including guides and other mountain users, or from mountain conditions.
We own the copyright. Under Austrian law copyright (Urheberrecht) in the photographs and footage remains with the photographer and cannot be transferred. What we grant you is a right of use (Werknutzungsbewilligung).
What you get. On payment in full, you receive a perpetual, worldwide, non-exclusive personal-use licence for the delivered images and footage. That means you may:
We ask, but do not require, that you credit @arlbergcollective when you post.
What the licence does not cover. Without a separate written commercial licence from us you may not:
Editing. You may crop lightly for social formats. Please do not apply heavy filters, re-colour or otherwise materially alter the images and continue to present them as our work.
Commercial licences are available and often inexpensive. Ask us.
We would like to show the work. Whether we may use pictures of you is your decision, and it does not affect your price.
Under § 78 Urheberrechtsgesetz you have a right to your own likeness. We will only use images in which you or your group are recognisable for our portfolio, website, social media or advertising if you have given us your consent, which we ask for at the time of booking.
You may withdraw that consent at any time by emailing hello@arlbergcollective.com. We will stop using the images in anything new and remove them from our own channels within a reasonable time. We cannot always recall material already printed or already shared onward by others.
Images in which nobody is identifiable — distant figures, landscapes, detail shots — may be used without specific consent.
We are liable without limit for damage caused intentionally or by gross negligence, for personal injury, and wherever Austrian law does not permit liability to be limited — including under the Produkthaftungsgesetz.
For slight negligence (leichte Fahrlässigkeit), our liability is limited to foreseeable damage typical of this kind of contract, and in any event to the total amount you paid for the session concerned.
We are not liable for indirect or consequential loss, including loss of the opportunity to obtain the images.
Technical failure. If equipment failure, data loss or corruption means we cannot deliver the images, our liability is limited to a refund of the fee for the affected session. We shoot to redundant media where practicable, but photography carries this risk and it cannot be eliminated.

If something is wrong, tell us first — most things are fixable. Email hello@arlbergcollective.com and we will respond, normally the same day.
Consumers may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are not obliged, and are not willing, to participate in dispute resolution proceedings before a consumer arbitration board.

Changes. We may update these terms. The version in force when you book is the version that applies to your booking.
Severability. If any clause is found invalid, the rest remain in force.
Governing law. Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in the EU, this choice does not deprive you of the protection of mandatory provisions of the law of your country of residence.
Jurisdiction. For businesses, the competent court in Landeck, Austria has exclusive jurisdiction. For consumers, the statutory rules on jurisdiction apply.
